Terms of Service

These Terms of Service (hereinafter referred to as "these Terms") set forth the conditions for using this Service (including this website; hereinafter no distinction is made between them). These Terms apply to all users who use this Service.

Agreement to These Terms

By using this Service, users are deemed to have given valid and irrevocable consent to these Terms. Users who do not agree to these Terms may not use this Service.

User Registration

Those who wish to use this Service shall apply for user registration by the method prescribed by us, upon agreeing to these Terms, and may register to use this Service upon our approval.

Refusal of Registration

We may refuse to approve an application for user registration if we determine that any of the following reasons apply. We are under no obligation to disclose the reasons for any such refusal.

  • If false information has been submitted
  • If the application is from a person who has previously violated these Terms
  • If we otherwise deem the registration to be inappropriate

Use by Minors

If a user is a minor, please use this Service with the consent of a legal guardian. Regarding smartphones and other devices necessary for using this Service, please be sure to use them with the consent of a legal guardian.

If a user who began using this Service without obtaining consent from a legal guardian reaches the age of majority, they shall be deemed to have ratified all acts of use during the period when they were a minor.

Management of Login Credentials

Users shall manage their login credentials for this Service appropriately at their own responsibility. Users may not, under any circumstances, transfer, lend, or share their login credentials with any third party. We shall bear no responsibility for any damage caused by the use of login credentials by a third party, except in cases of our own intentional or gross negligence.

Use of Content

We grant users a license for private use within the scope of this Service for text, images, videos, audio, music, software, programs, code, and other content provided by this Service. For paid content, private use within the scope of this Service is permitted upon completion of payment of the usage fees prescribed by us. This is a non-exclusive, non-transferable, and non-sublicensable right of use. Any use of content provided by this Service beyond this scope is strictly prohibited.

Users acknowledge in advance that, regardless of reason, if they lose the right to use this Service, they will no longer be able to use any content of this Service.

Late Payment Charges

Users who are late in paying monetary obligations to us shall pay late payment charges at an annual rate of 14.6%.

User Submissions

Users represent and warrant to us that they have the legal right to transmit the information contained in their submissions, and that such submissions do not infringe upon the intellectual property rights (including copyrights, patent rights, utility model rights, trademark rights, design rights, and the right to obtain or apply for such rights, as well as ideas and know-how), ownership rights, or other rights of any third party.

Copyright in user submissions shall be retained by the users themselves. We shall not acquire copyright in user submissions. However, we may reproduce, adapt, automatically transmit to the public, and make transmittable as necessary, user submissions free of charge, for an indefinite period, and without geographic limitation, to the extent necessary for the provision, maintenance, improvement, or promotion of this Service. In such cases, users shall not exercise their moral rights against us or those who have succeeded to or been licensed our rights.

Users must back up their submissions at their own responsibility. We shall not be obligated to back up user submissions.

Users shall not submit information that falls under any of the following:

  • Information that infringes upon intellectual property rights, portrait rights, privacy, honor, or other rights or interests of us or third parties
  • Information containing personal information that can identify users (except where required for registration or otherwise approved by us)
  • Information containing obscene expressions
  • Information aimed at meeting unknown third parties or engaging in obscene acts, regardless of gender
  • Information containing expressions that induce, solicit, or promote suicide or self-harm
  • Information related to the buying and selling of drugs or dangerous drugs, or containing expressions that promote the inappropriate use of such substances
  • Information related to the promotion or advertising of religious activities, religious organizations, political activities, or political organizations
  • Information related to solicitation for network businesses
  • Information containing text equivalent to junk mail or spam
  • Information that may have a negative influence on minors
  • Cruel expressions or other information that may cause discomfort to others
  • Information containing malicious programs such as computer viruses
  • Other information that we deem inappropriate

If we determine that user submissions violate these Terms or are otherwise inappropriate, we may delete, hide, or modify such submissions at our discretion without prior notice to the user. We are not obligated to monitor or delete such information.

Display of Advertisements

We may display our own or third-party advertisements within this Service.

Prohibited Activities

Users shall not engage in any of the following activities when using this Service:

  • Acts that violate or promote violation of laws, court judgments, decisions, orders, or legally binding administrative measures
  • Acts related to criminal activity
  • Acts that infringe upon our or third parties' intellectual property rights
  • Acts that infringe upon our or third parties' portrait rights, privacy, honor, or other rights or interests
  • Acts that place excessive burden on our or third parties' servers or networks, or that interfere with their normal operation
  • Acts that may interfere with the operation of our services
  • Unauthorized access or attempts thereof
  • Acts of analyzing the source code of this Service through reverse assembly, decompilation, reverse engineering, etc.
  • Acts of unauthorized access to systems connected to this Service or unauthorized alteration or deletion of information stored in our equipment
  • Acts of copying, transmitting, transferring, lending, or modifying the website or software of this Service
  • Acts of lending, transferring, or selling accounts or content on this Service to third parties for compensation
  • Acts of commercially using information obtained through this Service
  • Acts aimed at gaining profit in connection with this Service by means not intended by us
  • Advertising, solicitation, or sales activities on this Service not authorized by us
  • Acts of collecting or accumulating personal information about other users
  • Acts of using this Service for illegal, improper, or unjust purposes
  • Acts that cause disadvantage, damage, or discomfort to other users or third parties of this Service
  • Acts of impersonating other users
  • Acts of using other users' accounts
  • Acts aimed at meeting unknown persons of the opposite sex
  • Acts of directly or indirectly providing benefits to anti-social forces
  • Acts that violate public order and morals
  • Acts of using this Service while walking, driving, or in other inappropriate situations or manners
  • Other acts that we deem inappropriate

Prohibition of Monetization

The following transactions of any content or virtual currency obtained within this Service are strictly prohibited, regardless of the means:

  • Buying and selling
  • Any transfer, assignment, lending, borrowing, etc. involving monetary or other consideration
  • Any other acts that we deem to constitute monetization

Exclusion of Anti-Social Forces

Users represent and warrant that they do not currently, and will not in the future, fall under any of the following categories:

  • Being (including officers in the case of corporations or other organizations) a member of organized crime groups, a member who has not passed 5 years since ceasing to be a member, an associate member, a related enterprise, a corporate extortionist, a social movement racketeering group, a special intelligence violence group, or any similar entity (collectively, "Anti-Social Forces")
  • In the case of corporations or other organizations, having a relationship where Anti-Social Forces are deemed to control management
  • In the case of corporations or other organizations, having a relationship where Anti-Social Forces are deemed to be substantially involved in management
  • Having a relationship deemed to use Anti-Social Forces for the purpose of gaining unjust benefits for oneself or a third party or for the purpose of causing damage to a third party
  • Having a relationship deemed to be involved in providing funds or other benefits to Anti-Social Forces
  • In the case of corporations or other organizations, having officers or persons substantially involved in management who have socially condemnable relationships with Anti-Social Forces

Users warrant that they will not, by themselves or through third parties, engage in any of the following:

  • Violent demands
  • Unreasonable demands beyond legal responsibility
  • Threatening language or violence in relation to transactions
  • Spreading rumors, using fraud or force to damage our credibility or interfere with our business
  • Other acts similar to the foregoing

Restriction of Use

We may restrict all or part of a user's use of this Service, or delete a user's registration without prior notice if we determine that the user falls under any of the following. We shall bear no responsibility for any damage caused to users by actions taken under this provision.

  • Violation of any provision of these Terms
  • Discovery of false information in registration details
  • Default on monetary obligations
  • Failure to respond within a reasonable period to communications from us
  • No use of this Service for a considerable period since the last use
  • If we determine the user to be an Anti-Social Force or to have any involvement with Anti-Social Forces
  • If we otherwise deem the use of this Service to be inappropriate

Suspension of Service

We may suspend or interrupt the provision of all or part of this Service without prior notice to users if we determine that any of the following reasons exist. We shall bear no responsibility for any disadvantage or damage suffered by users or third parties in such cases.

  • When performing maintenance, inspection, or updates of the computer system related to this Service
  • When the provision of this Service becomes difficult due to force majeure such as earthquakes, lightning, fire, power outages, natural disasters, or virus outbreaks
  • When computers or communication lines are stopped due to accidents
  • When we otherwise determine that the provision of this Service is difficult

Withdrawal

Users may cancel their registration and withdraw from this Service through the procedures prescribed by us.

Disclaimer of Warranty

We do not warrant that this Service or the content provided by this Service is free from system bugs or infringement of third-party rights. We also do not warrant safety, reliability, accuracy, completeness, effectiveness, or fitness for a particular purpose.

Limitation of Liability

We shall bear no responsibility for any damage arising from this Service to users. However, this limitation of liability shall not apply if the contract between us and the user regarding this Service (including these Terms) constitutes a consumer contract as defined in the Consumer Contract Act.

Even in cases that constitute a consumer contract, we shall only be liable for direct and actual damages incurred by users due to our negligence (excluding gross negligence), and such compensation shall be limited to the lesser of one month's usage fee for this Service or 10,000 yen.

Changes to Service Content

We may change the content of this Service, or discontinue or terminate the provision of this Service without notifying users. Users agree in advance, without objection, that if this Service is terminated, they will lose all rights to use paid content and will no longer be able to use such paid content. We shall bear no responsibility for any damage caused to users by these changes.

Changes to Terms of Service

We may change these Terms at any time without notifying users. The revised Terms shall take effect from the time they are posted on our website. Users who continue to use this Service after the Terms have been changed shall be deemed to have agreed to the revised Terms.

Handling of Personal Information

Personal information of users obtained through the use of this Service shall be handled appropriately in accordance with our Privacy Policy.

Notices or Communications

Notices or communications between users and us shall be made by the method prescribed by us. Unless a user submits a change notification in the format separately prescribed by us, we shall deem the currently registered contact information to be valid and shall send notices or communications to such contact information, which shall be deemed to have reached the user at the time of dispatch.

Assignment of Rights and Obligations

Users may not transfer or pledge their position under the usage contract or any rights or obligations under these Terms to a third party without our prior written consent.

Business Transfer

In the event that we transfer the business related to this Service to another company (including all cases where the business is transferred, such as business transfer, company split, etc.), we may transfer the position under the usage contract, rights and obligations under these Terms, and user information to the transferee of such business transfer. Users shall be deemed to have consented in advance to such transfer.

Applicability

These Terms shall apply to all relationships between users and us regarding the use of this Service.

We may establish rules for use of this Service in addition to these Terms. These rules, regardless of their name, shall constitute a part of these Terms. In the event of any conflict between these Terms and such rules, the rules shall take precedence.

Severability

Even if any provision or part thereof of these Terms is determined to be invalid or unenforceable, such determination shall not affect other parts, and the remaining provisions of these Terms shall continue to be valid and enforceable.

Governing Law and Jurisdiction

These Terms shall be interpreted in accordance with the laws of Japan.

In the event of any dispute arising in connection with this Service, the district court having jurisdiction over the location of our head office shall be the exclusive agreed court of jurisdiction.
